PLEASE READ: These Terms include binding individual arbitration and a class-action waiver (Section 19). You can opt out of arbitration within 30 days by emailing keven@hgpoker.io with the subject “Arbitration Opt-Out.”
Updated October 22, 2026. This version adds a binding individual arbitration agreement with a class-action waiver and a 30-day opt-out (Section 19), clearer subscription, renewal and cancellation terms (Section 6), terms for the AI connector (Section 11), and the terms Apple requires for apps distributed through the App Store (Section 23).
These Terms of Service (“Terms”) are a contract between you and Keven Bermeo, the publisher and operator of HG Poker (“HG Poker,” “we,” “us,” or “our”). Keven Bermeo publishes and operates the HG Poker apps, the hgpoker.io website, the HG Poker web app and the “HG Poker for Claude & ChatGPT” connector, and distributes the app on the Apple App Store. On Google Play, the app is distributed through the developer account Lead Catch LLC, a Georgia (United States) limited liability company, which is also a party to these Terms for the app you obtain through Google Play. A dedicated HG Poker company is being formed; when the Service moves to it, we will update these Terms and tell you. They govern your use of HG Poker, including its mobile apps, web app, websites, game links, shared displays, AI connector, support services and related features (together, the “Service”).
Please read Section 19 carefully. It requires you and HG Poker to resolve most disputes through binding individual arbitration instead of in court, and it waives the right to bring or join a class action. You can opt out of arbitration within 30 days, as Section 19 explains.
By creating an account, signing in, downloading, accessing, purchasing or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years old, and old enough to form a binding contract where you live, to create an account or use the Service. If the law where you live sets a higher minimum age for taking part in poker games, card games or similar activities, you must meet that age too. The Service is not directed to children, and we do not knowingly allow anyone under 18 to create an account.
You may not use the Service if you are barred from doing so under the laws of the United States or the place where you live, or if we previously terminated your account for violating these Terms. If you use the Service for a club, league or other organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization.
HG Poker is scorekeeping and bookkeeping software for privately arranged, in-person poker games. It helps hosts and players create games, manage rosters, record buy-ins, rebuys, add-ons, chip counts, cash-outs, expenses and results, run tournament clocks and displays, keep history and standings, and calculate who owes whom at the end of a game.
HG Poker is not a gambling service. HG Poker does not:
The money amounts in HG Poker are records that users type in. Suggested settlements are calculations based on those records. Marking a settlement as paid, a host’s confirmation and Bank Mode only update records; they do not move money and do not verify that a payment happened. Bank Mode is a ledger, not a wallet, bank or payment service. Purchases you make from us (Section 6) pay for software features only. They never add money to a game, a pot or any player’s balance.
You are responsible for following the law. Laws about private poker games differ by country, state and city. You are solely responsible for making sure that any game you host, join or record complies with the laws that apply to you, including any rules about private social games, house fees, age limits and taxes. HG Poker does not decide, check or certify whether any game is lawful, and using HG Poker does not make a game lawful. Do not use HG Poker for any game that is unlawful where it is played.
We are not part of your settlements. Any payment between players is a private matter between those players, made outside HG Poker using whatever method they choose. HG Poker is not a party to, agent for, or guarantor of any settlement or debt between users, and we do not collect, enforce, mediate or resolve disputes about them. Players must check the records themselves before paying or accepting payment. The Service does not give financial, tax or legal advice.
You can create an account with the sign-in methods the Service offers (for example, Sign in with Apple or Google). Give accurate information, keep your devices and sign-in methods secure, and tell us promptly at keven@hgpoker.io if you think someone has accessed your account without permission. You are responsible for activity in your account, except to the extent it is caused by our failure to meet our own legal obligations.
Do not sell, rent, share or transfer your account, and do not create accounts to get around a restriction, limit or termination. We may ask for reasonable verification to protect accounts and the Service.
HG Poker is built for shared tables. What you enter can be seen by the host, by other people in the game, by connected members of a host’s table, and by anyone who receives a game, standings or other share link, as the Privacy Policy explains. Share links only with the people you intend to see them.
When you enter information about other people (for example names, results, amounts owed or payment handles), you confirm that you have a reasonable basis to record and share it for running your game, and that it is accurate to the best of your knowledge. Hosts are responsible for the records they keep. Do not impersonate anyone, claim a saved player who is not you, or share table information outside its intended audience.
You can disconnect from a table and delete your account with the controls in the app. Doing so does not necessarily remove another host’s own records of games you played or copies already shared with others. We do not provide a moderation or monitoring service for private tables, but you can report a concern through Support.
You keep ownership of the information and content you submit (“User Content”), such as game records, names, notes and photos. You give HG Poker a non-exclusive, worldwide, royalty-free licence to host, store, copy, process, transmit and display User Content, and to share it with the people and services you choose, only as needed to operate, secure, support and improve the Service, to comply with law and to exercise our rights under these Terms. This licence ends when User Content is deleted from the Service, except for copies already shared with other users at your direction, copies kept in backups for a limited time, and copies we must keep by law.
You confirm that you have the rights needed to submit your User Content and that it does not break the law or anyone’s rights. Do not upload passwords, authentication codes, full payment-card or bank details, or unlawful content. We may remove User Content that we reasonably believe breaks these Terms or the law.
If you send us feedback or suggestions, we may use them without restriction or payment to you.
Some features need a paid plan. We currently offer HG Poker Pro, an auto-renewing subscription (for example, monthly or yearly), and Hosting Passes, one-time purchases that each let you host one game. The plans, features, price, currency, billing period and any free trial or introductory offer are shown on the purchase screen before you buy, and that screen controls if it differs from anything else we have published. Taxes may be added where required. Joining a game someone else hosts is free.
A Hosting Pass is a software allowance. It is not money, chips, a stake, a wager or a prize, has no cash value, cannot be transferred, sold or redeemed for cash, and never adds funds to any game or pot. Unused passes stay with your HG Poker account. Restore Purchases restores active subscriptions and other eligible purchases; it does not restore passes you already used. Free allowances depend on your account’s plan and may differ for older accounts.
Pro unlocks extra host tools, including table-wide Insights that eligible connected members of the host’s table can view. That shared access is a feature of the Service; it is not Apple Family Sharing.
Pro subscriptions renew automatically at the end of each billing period (for example, every month or every year) and you will be charged the then-current price for your plan, plus any applicable tax, using the payment method on file with the store or checkout you bought through, until you cancel. Your subscription renews unless you cancel at least 24 hours before the end of the current period (or before the deadline the store or checkout shows, if different). If you start a free trial or an introductory offer, it turns into a paid subscription at the regular price shown at purchase when the trial or offer ends, unless you cancel before then. If we change the price of your subscription, we will tell you in advance as required by law and by the store, and where required we will ask for your consent; you can cancel before the new price applies.
When you cancel, you keep Pro until the end of the period you already paid for, and you are not charged again. Deleting the app or your HG Poker account does not cancel a subscription bought through Apple or Google; cancel it in the store as described above. For purchases made on our website, we email you an order confirmation that includes these renewal and cancellation terms, and for annual plans we email you a reminder before each renewal.
Purchases through the App Store or Google Play are processed by Apple or Google, and refunds are handled under their policies; we cannot issue refunds for those purchases ourselves. You can request an App Store refund at reportaproblem.apple.com and a Google Play refund through Google Play. The following applies to purchases on our website or web app, when offered: you can cancel a web subscription at any time in Settings → Your plan, and it stays active until the end of the period you paid for. Except where required by law, we do not give refunds or credits for partial periods.
EU and UK consumers. If you are a consumer in the EU or UK and buy on our website, you have a right to withdraw from the purchase within 14 days without giving a reason. To withdraw, email us a clear statement within that period, and we will refund you using the original payment method. However, digital content and services can start right away: if you expressly ask us to start providing the paid features immediately, you acknowledge that you lose your right of withdrawal once the service has been fully performed, and if you withdraw before then, we may deduct an amount in proportion to what was provided up to the time you told us you were withdrawing. Nothing in these Terms limits any other right you have under consumer law.
We may change what each plan includes, add or remove features, or change prices for the future. Changes do not affect a period you already paid for, and price changes for existing subscribers follow Section 6.2.
Subject to these Terms, we give you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to use the Service for its intended purpose on devices you own or control. If you got the app from the App Store, this licence is also subject to the Usage Rules in Apple’s Media Services Terms. We and our licensors keep all other rights.
You may not, and may not help anyone else to:
Nothing here restricts activity that the law does not allow us to restrict. These Terms do not claim ownership of game rules, facts or ideas.
The Service, including its software, designs, text, graphics, logos and other materials, is owned by HG Poker or its licensors and protected by intellectual-property laws. “HG Poker,” “Home Game Poker” and related logos are our trademarks. These Terms do not give you any right to use them.
The Service works with services run by other companies, including Apple (App Store, Sign in with Apple, push notifications), Google (Google Play, Google sign-in, Firebase Cloud Messaging), RevenueCat (purchase and subscription management), Stripe (payment processing for web purchases, when available), Supabase (hosting), and AI assistants you choose to connect (Section 11). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services, and they are not responsible for HG Poker.
You can choose to connect your HG Poker account to an AI assistant that supports the Model Context Protocol (MCP), such as ChatGPT or Claude. The connection is optional. When you connect, you authorize that assistant to read the records the connector makes available and, where the feature is offered, to make the changes you ask for (for example, starting a game or recording a buy-in) in your account.
We may change, suspend or stop any part of the Service. We do not promise that the Service will always be available or that any feature will continue. If we stop offering a paid feature you have already paid for, we will give any refund or other remedy the law requires. Keep your own copies of records that matter to you; you can export eligible data from the app.
You can stop using the Service and delete your account at any time in the app. We may suspend or terminate your access if we reasonably believe you broke these Terms or the law, created a risk for other users, us or the Service, or if we must do so by law. Where appropriate and allowed, we will tell you why and give you a chance to respond. If we terminate your account without cause, we will refund any prepaid, unused subscription fees you paid to us directly.
Sections that by their nature should survive termination will survive, including Sections 2, 5, 9 and 14 through 24.
TO THE FULLEST EXTENT ALLOWED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT CALCULATIONS, STANDINGS, SETTLEMENTS OR AI OUTPUT WILL BE CORRECT, THAT DATA WILL NOT BE LOST, OR THAT USE OF THE SERVICE MEETS ANY GAMING, TAX, FINANCIAL OR RECORDKEEPING LAW.
Some places do not allow certain warranty disclaimers, so some of this section may not apply to you. If you are a consumer in the EU or UK, you keep your statutory rights for digital content and services that are not as described or not of satisfactory quality.
TO THE FULLEST EXTENT ALLOWED BY LAW, HG POKER AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF REVENUE, INCOME, BUSINESS, GOODWILL, DATA OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
WE ARE NOT LIABLE FOR ANY AMOUNT ONE USER OWES ANOTHER, ANY PAYMENT MADE OR NOT MADE BETWEEN USERS, ANY DISPUTE ABOUT A GAME, ANY INCORRECT RECORD OR CALCULATION, OR ANY ACTION TAKEN BY AN AI ASSISTANT YOU CONNECTED.
TO THE FULLEST EXTENT ALLOWED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US $100.
These limits do not apply to liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer in the EU or UK, we are responsible for foreseeable loss caused by our breach of these Terms or our failure to use reasonable care and skill.
To the extent allowed by law, you will defend, indemnify and hold harmless HG Poker and its owners, officers, employees, contractors and agents from third-party claims, losses, liabilities and reasonable costs (including reasonable attorneys’ fees) arising out of: your User Content; your games and any settlement, payment or dispute between you and other players; your violation of law or of these Terms; or your violation of anyone else’s rights. We will tell you about any such claim and may take part in the defence with our own counsel. This section does not apply to EU or UK consumers to the extent their local law does not allow it.
Most concerns can be solved quickly. Before starting arbitration or a small-claims case, you and HG Poker each agree to send the other a written notice describing the dispute and the relief sought, and to try in good faith to resolve it for at least 60 days. Send your notice to keven@hgpoker.io with the subject “Dispute Notice,” including your name, the email address on your account and a description of the dispute. We will send ours to the email address on your account. The notice must be personal to the individual who sends it. Any deadline to file a claim is paused while this process is under way.
These Terms and any dispute between you and HG Poker are governed by the Federal Arbitration Act and the laws of the State of Georgia, United States, without regard to its conflict-of-law rules. Subject to Section 19, any dispute not subject to arbitration will be brought only in the state or federal courts located in Fulton County, Georgia, and you and HG Poker consent to those courts. If you are a consumer outside the United States, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings in your local courts where your law allows.
This section applies if you live in the United States, or if you live elsewhere to the extent allowed by your local law. Please read it carefully; it affects your legal rights.
Except as stated in Section 19.3, you and HG Poker agree that any dispute, claim or controversy arising out of or relating to these Terms, the Service, or your relationship with HG Poker, whether based on contract, tort, statute, fraud or any other legal theory, and whether it arose before or after you accepted these Terms (a “Dispute”), will be resolved by final and binding individual arbitration, not in court. The arbitrator decides all questions about whether a Dispute must be arbitrated, including the scope, enforceability and validity of this section, except as stated in Sections 19.4 and 19.7.
The arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect, as changed by this section (available at adr.org). A single arbitrator will decide the Dispute. Unless you and HG Poker agree otherwise, the arbitration will take place by video, by phone or on written submissions; if an in-person hearing is needed, it will take place in the county where you live. Payment of filing, administration and arbitrator fees will follow the AAA Consumer Arbitration Rules; for claims under $10,000 that are not frivolous, we will pay the fees beyond what you would pay to file in court. The arbitrator may award the same individual relief a court could award, but only in favour of the individual party seeking relief and only to the extent needed for that party’s individual claim. The award is binding and may be entered as a judgment in any court with jurisdiction.
Either of us may bring an individual claim in small-claims court instead of arbitration if it qualifies and stays there on an individual basis. Either of us may also go to court to stop actual or threatened infringement, misappropriation or violation of copyrights, trademarks, trade secrets, patents or other intellectual property, or unauthorized access to the Service.
YOU AND HG POKER AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. YOU AND HG POKER EACH WAIVE THE RIGHT TO A JURY TRIAL. The arbitrator may not combine more than one person’s claims (except as provided in Section 19.5) and may not preside over any form of class or representative proceeding. If a court decides that this Section 19.4 cannot be enforced for a particular claim or type of relief, that claim or relief (and only that claim or relief) will be severed and decided in court after the arbitration of all other claims, and the court proceeding will be paused until the arbitration ends. Any request for public injunctive relief that the law does not allow to be waived will likewise be decided by a court after the individual arbitration.
If 25 or more similar Disputes are brought against HG Poker by or with the help of the same or coordinated lawyers or organizations (“Mass Filing”), then: (a) the AAA Mass Arbitration Supplementary Rules will apply; (b) the Disputes will be handled in batches of no more than 50 claimants each, with one arbitrator per batch, and the first batch will proceed as a set of bellwether cases while the others are paused; (c) after the bellwether awards, the parties will mediate in good faith for at least 60 days before further batches proceed; and (d) the deadlines for paused Disputes to be filed are suspended while they wait. Each claimant must still meet the notice requirement in Section 17 individually. A court may enforce this section, including by ordering batches to proceed. If any part of this Section 19.5 cannot be enforced, the remainder of Section 19 still applies.
You can opt out of this arbitration agreement by emailing keven@hgpoker.io within 30 days after you first accept these Terms (for existing users, within 30 days after this version is posted). Use the subject “Arbitration Opt-Out” and include your name, the email address on your HG Poker account and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms, and it does not affect any earlier arbitration agreement you made with us. If you opt out, Section 18 decides where disputes are heard.
If we change this Section 19, we will give you at least 30 days’ notice, and the change will not apply to any Dispute you notified us of before the change took effect. If a court or arbitrator decides that Section 19 as changed does not apply to a Dispute, the most recent version you accepted will apply.
To the extent allowed by law, any Dispute must be brought within one year after it arose; otherwise it is permanently barred.
We may update these Terms. We will post the new version with a new effective date and, for material changes, give reasonable advance notice, for example by email, in the app or on this page. Changes apply going forward and not to Disputes that arose before them. If you keep using the Service after the changes take effect, you accept them; if you do not agree, stop using the Service and cancel any subscription. Where the law requires your express agreement, we will ask for it.
You must comply with all export-control and sanctions laws that apply to the Service. You confirm that you are not located in a country subject to a comprehensive U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
These Terms, the Privacy Policy and any terms shown at the point of purchase are the whole agreement between you and HG Poker about the Service and replace earlier versions, except that an earlier arbitration agreement you made with us continues to apply to the extent stated in Section 19.6. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect, except as stated in Section 19.4. If we do not enforce a provision, that is not a waiver. You may not assign or transfer these Terms without our written consent; we may assign them in connection with a merger, acquisition, reorganization or sale of assets, or to an affiliate. Neither of us is liable for delays caused by events beyond reasonable control. Notices to you may be sent to the email on your account or shown in the app. Headings are for convenience only, and “including” means “including without limitation.” If these Terms are translated, the English version controls to the extent the law allows.
If you downloaded the app from Apple’s App Store, these Terms are between you and HG Poker only, not Apple, and the following also applies:
If you downloaded the app from Google Play, the Google Play Terms of Service also apply to your use of Google Play. Google is not responsible for the app.
HG Poker — published and operated by Keven Bermeo, Georgia, United States (apps, website, web app and the “HG Poker for Claude & ChatGPT” connector). On Google Play the app is distributed through the developer account Lead Catch LLC.
